Ten years have passed since the collective bargaining agreement on non-compete clauses was concluded between the Confederation of Swedish Enterprise (Sw. Svenskt Näringsliv) and PTK — a milestone that calls for reflection on how the agreement has worked in practice and what insights can be drawn.
Drawing on two recent arbitration rulings, the team analyzes how key provisions of the collective bargaining agreement on e.g. reasonableness, are applied in specific cases. They also explore the essential criteria for a non-compete clause to hold up under legal scrutiny.
